The Interim Measures of Daxing District for Promoting the Development of Intellectual Property Rights

Chapter I: General Provisions

Article 1: In order to accelerate the implementation of the spirit of documents such as the "Several Opinions of the State Council on Accelerating the Construction of a Strong Intellectual Property Country under the New Situation" (Guofa [2015] No. 71), the "Regulations on Patent Protection and Promotion in Beijing", the "Measures for Promoting the Work of the" Two Districts "of the Beijing Intellectual Property Office" (Jingzhi Bureau [2021] No. 35), and the "Guiding Opinions on Promoting the High quality Development of Industries in Daxing District" (Jingxing Zhengfa [2022] No. 22), accelerate the creation of pilot cities for the construction of a strong national intellectual property city, and promote the high-quality development of regional intellectual property, these measures are formulated.

Article 2 These Measures apply to enterprises, institutions, social organizations, private non enterprises, intellectual property service institutions, and other entities engaged in patent and trademark related activities. A patent is an authorized patent, and the project applicant should be the first patentee; The trademark is a registered trademark, and the project applicant should be the exclusive owner of the trademark. For projects with joint registered trademark exclusive rights, the project applicant should be the representative of the joint trademark.

Chapter II. Support methods

Article 3: Encourage the creation of high-quality intellectual property rights. For the subjects who have won the China Patent Award Gold Award, Silver Award, and Excellence Award, each item will be given a financial reward of 200000 yuan, 100000 yuan, and 50000 yuan, respectively. For the main body that has won the gold, silver, and excellent awards of the China Design Award, a financial reward of 200000 yuan, 100000 yuan, and 50000 yuan will be given for each item respectively; For the subject who has won the special prize, first prize, second prize, and third prize of the Beijing Invention Patent Award, a financial reward of 100000 yuan, 50000 yuan, 30000 yuan, and 20000 yuan will be given for each item. The total amount of support funds for each entity each year shall not exceed 300000 yuan.

Article 4: Assist in the construction of intellectual property brands. For enterprises that have won the title of National Intellectual Property Demonstration Enterprise and Advantage Enterprise for the first time, they will be given a financial reward of 100000 yuan and 50000 yuan respectively. For enterprises that have obtained intellectual property advantages in Beijing for the first time, a financial reward of 50000 yuan will be given; For those who have been awarded the title of benchmark and excellent intellectual property public service workstation in Beijing, a financial reward of 50000 yuan will be given. A financial reward of 30000 yuan will be given to the subject who has won the individual excellent award of Beijing Intellectual Property Public Service Workstation.

Article 5: Support the protection of intellectual property rights. For the subject who wins the lawsuit for intellectual property rights protection, according to relevant effective legal documents, 50% of the actual lawyer's fees incurred in the case will be provided with financial support of no more than 100000 yuan for a single case, with a total annual financial support of no more than 300000 yuan for each subject; For entities that have already purchased patent insurance, a financial support of no more than 100000 yuan will be provided based on 50% of their actual annual patent insurance expenses, with each entity's support period not exceeding three years.

Article 6: Support the implementation of patent conversion and utilization. For entities in the fields of medicine and health, digital economy, new generation information technology, intelligent equipment, and technology services, patent conversion projects shall be organized and implemented through patent transfer and licensing. Each project shall be provided with a financial support of no more than 500000 yuan, based on 5% of the actual expenditure on patent transactions; Support entities to carry out intellectual property strategy formulation, patent navigation, and patent warning projects, and provide financial support of no more than 300000 yuan based on 30% of the actual expenses incurred for each project. The total annual financial support for each entity shall not exceed 2 million yuan.

Article 7: Support the development of intellectual property financing. For entities that have obtained intellectual property pledge loans and have been settled, a subsidy of 50% of the actual annual loan interest will be provided. Each entity can apply for a maximum of one loan subsidy per year, with a total subsidy amount not exceeding 300000 yuan. For financing through combination loans, only the portion of intellectual property pledge financing loans will be calculated. If the amount of intellectual property pledge financing cannot be calculated in the combination loan, it will not be subsidized; For entities financing through intellectual property asset securitization, a one-time financial support of no more than 500000 yuan will be provided at a rate of 2% of the actual financing amount after the project matures and pays interest. The subsidy period for each entity shall not exceed three years.

Article 8: Encourage intellectual property service institutions to grow and strengthen. For intellectual property service institutions registered with the Market Supervision Administration of Daxing District, Beijing (Intellectual Property Bureau), a financial support of no more than 100000 yuan shall be provided based on 10% of their service income from intellectual property agency, pledge financing, and conversion operations for enterprises in the district in the previous year.Each institution's support period shall not exceed three years.

Chapter III. Support methods

Article 9: Collection and evaluation. The Market Supervision Administration of Daxing District, Beijing (Intellectual Property Bureau) publicly solicits and organizes experts to conduct project reviews every year.

Article 10 Review and Publicity. Projects that have passed the review shall be publicly announced on the website of the Daxing District Government for a period of no less than 5 working days. After the public notice period ends, support shall be given to projects that have no objections to the public notice. During the public notice period, any unit or individual who holds objections shall submit written opinions and relevant evidence within the public notice period. Failure to do so shall not be accepted.

Article 11: Fulfilling supervision. The support funds will be disbursed and cashed out after being jointly reviewed and approved by the Leading Group for Promoting Industrial Development in Daxing District. For the reporting entities found to have serious problems during auditing and supervision inspections that violate regulations after verification, they shall not apply for these measures within three years from the date of discovery and shall return the funds obtained within a specified period of time.

Chapter IV. Supplementary Provisions

Article 12: These Measures shall come into effect from the date of promulgation and shall be interpreted and organized for implementation by the Market Supervision Administration of Daxing District, Beijing (Intellectual Property Bureau). If the same enterprise and project simultaneously comply with other policies and regulations of Daxing District, support shall be provided based on the principle of selecting the best and not repeating, except as otherwise specified. During the implementation period, if there are changes in relevant national and Beijing policies, corresponding adjustments will be made.
